Massachusetts

Enacted legislation: Massachusetts is generally pro-choice, with still a few barriers to later term abortion. The state has not repealed its pre-Roe abortion ban, which is unconstitutional and unenforceable. Massachusetts has also enforced an unconstitutional limit on abortions at 24 weeks post-implantation except in cases where the life or health (physical or mental) of the woman is endangered. Massachusetts also allows certain individuals or entities to refuse to provide women abortions. Furthermore, Massachusetts also subjects abortion providers to burdensome restrictions not applied to other medical professionals via Targeted Regulation of Abortion Providers (TRAP) laws.

Restrictions:
Unconstitutionally limits abortion by gestational age after viability
Prohibits later abortion except to preserve a woman's life or health (physical or mental)

Pending legislation:

In January 2017, Massachusetts Representative Elizabeth A. Poirier introduced an unconstitutional 20-week ban on abortion, HB 934. The bill would ban all abortions at 20 weeks post-fertilization and contains narrow health and life exceptions. The bill includes onerous reporting requirements for physicians that perform abortions in the event of a medical emergency. To view the latest bill status, click here
